For purposes of the Agreement, "force majeure" shall mean circumstances or occurrences beyond EFFRO SAFE's reasonable control, whether or not foreseeable at the time of entering into the Agreement, in consequence of which EFFRO SAFE cannot reasonably be required to perform its obligations hereunder or otherwise perform its obligations under the Agreement. Such circumstances or occurrences include, but are not limited to: acts of God, war, civil war, insurrection, fires, floods, labor disputes, epidemics, governmental regulations and/or similar acts, embargoes, termination or temporary unavailability of any computer hardware or software, server, or network on which the EFFRO SAFE Services are located or maintained or through which the EFFRO SAFE Services are provided, and nonavailability of any permits, licenses and/or authorizations required by governmental authority.
You agree that EFFRO SAFE is not responsible for any delay in call or SMS alerts since it involves interlinking of several networked devices. You agree that user may never get a call or SMS alert due to unexpected server downtime. You agree that EFFRO SAFE is not responsible for underperformance of service due to poor or no response from third party devices. EFFRO SAFE is not responsible, unless until specified in written or openly disclosed of collaboration, for damages caused by third party websites and other online sales websites. It is mandatory that your registered mobile network with EFFRO SAFE should be reachable all the time. EFFRO SAFE is not liable/responsible for not triggering alarm/alert at any cost due to your mobile network being unreachable.
